ABOUT THE ATTORNEY:
Alan S. Diamond, Esq. is Board Certified Criminal Trial Lawyer, and has been the attorney of record in over 11,000 criminal cases. Mr. Diamond graduated from the University of North Carolina – Chapel Hill, with a Bachelor of Arts degree in International Studies. He received his law degree in 1992 from the University of North Carolina Chapel Hill College of Law.
Mr. Diamond was an Assistant State Attorney and Felony Division Chief in the 18th Judicial Circuit. He served the 18th Circuit as a prosecutor for more than a decade. He prosecuted all types of cases including; Homicides, Kidnappings, Vehicular Manslaughters, White Collar Crime, Sex Crimes and Child Abuse cases as well as Computer Crimes. Alan Diamond received the Outstanding Trial Attorney of the Year award prior to becoming a Felony Division Chief.
Mr. Diamond is a former instructor with the Florida Prosecuting Attorney Association focusing on DUI law and received the 2002 Distinguished Faculty award from the FPAA.
During his career as a criminal attorney in Melbourne Florida, Mr. Diamond has handled numerous cases in both State and Federal Court. Specifically, Mr. Diamond successfully defended a NASA Space Shuttle quality assurance specialist who was indicted for 166 counts of fraud involving the Space Shuttle in Federal Court. Alan Diamond has also successfully represented victims of felonies as well as those people seeking injunctions for protection. In addition, he has tried cases of all types, from misdemeanors to homicides in both State and Federal Court. He has significant jury trial experience representing those accused of a myriad of crimes including; rape, DUI, murder, burglary, drug trafficking, sex crimes, computer crimes and others.
Now in private practice, he is a Board Certified Criminal Trial Expert and the 2005 recipient of the Brevard County Bar Association Professionalism Award. He was selected a top 100 Trial Lawyer in Florida every year from 2012 through 2016. His memberships include The Federal Bar Association, Supreme Court of the United States, U.S. District Court – Southern, Middle and Northern Districts of Florida, U.S. Court of Appeals for the 11th Circuit, the Brevard County Bar Association where he was elected to the offices of Treasurer, President-Elect and elected President of the BCBA from 2012 through 2013. He is also a member of The Florida Bar, The National and Florida Associations of Criminal Defense Lawyers and the American Bar Association.
Mr. Alan Diamond was the General Counsel for the Florida State Lodge of the Fraternal Order of Police from 2013-2018 and oversaw all legal issues for the F.O.P. and over 130 F.O.P. attorneys statewide. For more than 15 years he has represented police officers whenever there is an on-duty shooting to insure that no criminal charges are brought and to make sure that the officer’s rights are protected. Mr. Diamond has personally handled more than 50 officer involved shootings, excessive use of force allegations and in-custody death situations. He has defended many situations involving criminal allegations where he convinced the government that the use or threat of deadly force was justified.
Mr. Diamond also teaches classes to Law Enforcement Agencies, attorneys and private citizens regarding the use of force and the criminal/ legal implications thereof. Additionally, he teaches Florida Bar CLE courses on the topics of basic firearms use which included hands on firearm training as well as the law surrounding the use of deadly force in Florida specifically focusing on the “stand your ground” and “castle doctrine” legislation.
He is a recent graduate of the Force Science ® Institute and has completed training on the principles of Force Science and is certified to apply these principles to the analysis in use of force incidents. These principles focus on the use of deadly force in self-defense situations.
He is an inaugural member of the USCCA (United States Concealed Carry Association) Legal Advisory Board. The USCCA's mission is to educate, train and legally protect people involved in self-defense, deadly force encounters. During his 23+ year career as a criminal law attorney Mr. Diamond has handled thousands of cases in both State and Federal Court. He has litigated hundreds of cases involving the use or possession of firearms and the legal issues surrounding those allegations. He has litigated issues before FDLE and the Florida Department of Agriculture regarding concealed weapons permitting and the right to own and possess firearms.
